Detr\u00e1s del complejo entramado jur\u00eddico, la constituci\u00f3n del fondo de limitaci\u00f3n de responsabilidad genera una lamentable inestabilidad, especialmente para los productores nacionales de cerezas, ciruelas, ar\u00e1ndanos y otros productos perecibles\u00bb<\/em>, afirm\u00f3 Valdivia.<\/p>\n\n\n\n<p>El abogado explic\u00f3 que <em>\u00abal limitar su responsabilidad a poco m\u00e1s de 15 mil millones de pesos -exactamente $15.213.309.162 pesos chilenos, calculados en funci\u00f3n del tonelaje bruto de la nave (95.128 toneladas) y el valor del Derecho Especial de Giro fijado por el Banco Central de Chile- y respaldados por una garant\u00eda ligeramente superior de $16 mil millones de pesos chilenos otorgada por la aseguradora Gard P&amp;I (Bermuda) Ltd., la compa\u00f1\u00eda busca blindarse frente a las leg\u00edtimas demandas por da\u00f1os derivados del incumplimiento en plazos y condiciones del transporte\u00bb<\/em>.<\/p>\n\n\n\n<p><em>\u00abEste movimiento de Maersk amenaza con dejar a muchos exportadores en una posici\u00f3n vulnerable, ya que implica la suspensi\u00f3n inmediata de ejecuciones individuales y arraigos, adem\u00e1s de congelar cualquier intento de cobro individual fuera del procedimiento ya iniciado ante el 5\u00b0 Juzgado Civil de Valpara\u00edso\u00bb<\/em>, manifest\u00f3.<\/p>\n\n\n\n<p>Asimismo, Valdivia enfatiz\u00f3 que <em>\u00abla inquietud no es menor. Esta acci\u00f3n podr\u00eda desencadenar tensiones comerciales significativas y conducir a una compleja batalla legal que pondr\u00e1 a prueba la resiliencia del tejido exportador chileno\u00bb<\/em>.<\/p>\n\n\n\n<p><em>\u00abEl caso ha comenzado formalmente y el precedente que pueda sentarse debe observarse con atenci\u00f3n cr\u00edtica. Aqu\u00ed est\u00e1 en juego mucho m\u00e1s que dinero: se pone en jaque la capacidad del comercio exterior chileno para exigir responsabilidades claras a las navieras frente a incidentes como el
